General Terms and Conditions of Sale (GTC)

1. Seller's identity and contact
Avel & Men is operated by CHALAKO&CO SAS, registered with the Brest Trade and Companies Register under number 818 042 251.
Head office: CHALAKO&CO SAS – Avel & Men, 25 rue de Kerdelvas, 29840 Porspoder, France.
Customer service: Monday to Friday, 9am–6pm (CET) via the website form and/or info@avelandmen.com . Response within 24–48 business hours.
2. Scope
These Terms and Conditions apply to all orders placed by a consumer on the website www.avel-and-men.com. For B2B sales, specific conditions may apply.
3. Products and customization
Product characteristics are described with care. Slight variations (e.g., colors, leather grain) may exist.
The following are considered "personalized products" and are subject to a "made-to-measure" surcharge: (i) cases and pouches with individual laser-engraved markings; (ii) custom-made bracelets (special size and/or length). These products are excluded from the right of withdrawal (see Article 11).
4. Prices, currencies and taxes
Prices are shown in euros, inclusive of all taxes (TTC), excluding any delivery charges.
For deliveries outside the European Union, import duties and taxes are the responsibility of the customer (recommended Incoterm: DAP).
In the event of a clear pricing error, Avel & Men may cancel the order or offer the customer to maintain it at the corrected price; the customer may refuse and be fully refunded.
5. Order and Contract Formation
The order is completed upon validation of payment on the payment page. A confirmation email summarizing the order will be sent.
The applicable terms and conditions are those in effect on the date of the order. Orders and invoices are archived in accordance with the law.
6. Payment
Accepted payment methods: bank card (Visa/Mastercard/Amex) and PayPal.
Bank transfer (exceptionally): the order is prepared/shipped after receipt of funds. If payment is not received within 10 business days, the order may be automatically cancelled.
Invoice: an invoice is sent by email after confirmation of payment and can be accessed from the customer area if applicable.
7. Availability and preparation times
Standard items: indicative preparation within 2–5 working days.
Customized products: delivery time can take up to 6 weeks.
In case of unavailability, Avel & Men will issue a refund, or with the customer's agreement offer an equivalent product, or a credit note.
8. Delivery — Zones, Fees and Tracking
8.1 Zones and fees
European Union (EU): Free delivery to the 27 Member States listed in Annex A.
Large Export (outside EU): shipping costs charged at actual cost and displayed when placing the order (automatic calculation according to carrier, destination and weight/volume).
8.2 Deadlines and monitoring
Delivery times are indicative and vary depending on the carrier and destination. A tracking number will be provided upon shipment.
8.3 Address, absence and reshipment
If delivery fails due to an incomplete/incorrect address provided by the customer, or an absence preventing delivery, reshipment may be offered and charged.
8.4 Transfer of Risk and Ownership
Risk is transferred upon the customer taking possession of the products. Ownership is transferred after full payment.
9. Reception and transport anomalies
Upon receipt, the customer checks the condition of the package and the products. In case of damage or missing items, they inform the carrier and Avel & Men as soon as possible to open an investigation; the outcome may lead to a delivery, a replacement, a credit note or a refund depending on availability.
Reporting non-delivery: To facilitate processing, any non-delivery should be reported to customer service within an indicative period of 10 days from the estimated delivery date communicated by the carrier.
10. Right of withdrawal (14 days) - returns
10.1 Exercise of rights
The Customer has 14 days from receipt to withdraw from the contract, without giving any reason (Consumer Code L221-18). Products must be returned within 14 days of the decision (L221-23). The Customer must notify Avel & Men of their return request by email. The refund will be issued within 14 days of receipt of the returned goods or proof of shipment (L221-24). Return shipping costs are the responsibility of the Customer, except in the case of an error attributable to Avel & Men (L221-23). Exceptions: notably, personalized Products (L221-28).
10.2 Return costs and condition
Unless the error is attributable to Avel & Men, return shipping costs are the responsibility of the customer.
Products must be unworn, unused, complete and in their original packaging (including tags and accessories).
10.3 Return address
You will receive an email with the return details after the customer notifies you of the return request. Please include the order number inside the package.
11. Exceptions to the right of withdrawal
The right of withdrawal does not apply to personalized products, including: (i) laser-engraved cases/boxes with individual marking; (ii) custom-made bracelets (special size/length).
12. Legal guarantees and after-sales service
The Products are covered by the legal guarantee of conformity (French Consumer Code, Art. L217-3 et seq.) and the guarantee against hidden defects (French Civil Code, Art. 1641 et seq.). The Customer may request that the Products be brought into conformity (repair or replacement) or, failing that, a price reduction or cancellation of the contract. These guarantees are exercised free of charge for the Customer and independently of the right of withdrawal.
Without prejudice to these rights, Avel & Men may, on a case-by-case basis, grant a commercial gesture (exchange, replacement, credit note), without automatic character.
13. Consumer mediation and dispute resolution
The customer can use a consumer mediation service.
14. Personal data and cookies
Data processing is described in the Privacy Policy and Cookie Policy, which are accessible on the website.
15. Intellectual Property
The trademarks, texts, visuals and content of this site are protected. Any unauthorized reproduction is prohibited.
16. Force majeure
Neither party is liable for any failure due to a force majeure event as defined by French/EU law (unforeseeable, irresistible and external).
17. Third-party service providers
Some sales-related services are operated by third-party providers (e.g., payment platforms, carriers). Their terms and conditions apply to their respective areas of operation, without limiting Avel & Men's legal obligations as the seller.
18. Information corrections
The information displayed may contain errors or omissions (prices, availability, descriptions). Avel & Men reserves the right to correct this information and to cancel or adjust any unshipped order affected by a clear error; the customer may then choose a full refund.
19. Updates to the General Terms and Conditions
Avel & Men may update these Terms and Conditions. The effective date is shown in the header. Orders remain governed by the Terms and Conditions in effect on the date of purchase.
20. Applicable Law and Jurisdiction
These Terms and Conditions are governed by French law. Disputes will be brought before the competent courts in accordance with ordinary law, without depriving the consumer of the mandatory protections of their country of residence within the European Union.
